Welcome to BikriAI. By accessing or using our website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
1. Definitions
"Company" — BikriAI.
"Service" — The BikariAI platform, including the website, dashboard, AI agent, and all related features.
"User" / "You" — Any individual or entity using the Service.
"AI Agent" — The automated artificial intelligence system that responds to customer messages on connected platforms.
"Credits" — The virtual currency used to pay for AI agent conversations.
2. Account Registration
2.1 Eligibility
You must be at least 13 years old to create an account. By registering, you represent that you meet this requirement.
2.2 Account Responsibility
You are responsible for:
Providing accurate, complete, and current registration information.
Maintaining the security and confidentiality of your account credentials.
All activities that occur under your account.
Notifying us immediately at support email of any unauthorized account use.
2.3 Account Termination
We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms or engage in prohibited activities.
3. Service Description
BikaiAI provides an AI-powered automation platform that:
Connects to your Facebook Page and WhatsApp Business account via official APIs.
Uses an AI agent to automatically reply to customer messages.
Shares product information and processes orders via chat.
Deducts credits from your balance for each conversation handled.
4. Credit System
4.1 Purchasing Credits
Credits are purchased in packages as displayed on our platform. Prices are listed in BDT and are subject to change. All purchases are final, subject to our Refund Policy.
4.2 Credit Usage
One credit is deducted per message handled by the AI agent, as shown in your credit(s) per message. Credits have no cash value and cannot be exchanged for money except as provided in our Refund Policy.
4.3 Credit Expiration
Credits do not expire.
5. Acceptable Use
You agree not to:
Use the Service for any illegal or unauthorized purpose.
Send spam, phishing messages, or unsolicited promotional content through the AI agent.
Impersonate any person or entity or falsely state your affiliation.
Interfere with or disrupt the Service, servers, or networks.
Attempt to reverse engineer, decompile, or extract the AI agent's source code.
Use the Service to transmit malware, viruses, or harmful code.
Violate the terms of service of Meta (Facebook/WhatsApp) through your use of our platform.
Harass, abuse, or harm others through the AI agent.
6. Third-Party Platforms
Our Service integrates with Facebook Messenger and WhatsApp Business, which are owned and operated by Meta Platforms, Inc. Your use of these platforms is also governed by their respective terms of service and policies. We are not responsible for changes, outages, or restrictions imposed by these third-party platforms.
7. Intellectual Property
7.1 Our Property
The platform, including its software, code, design, logos, and branding, is the exclusive property of BikriAI and is protected by copyright and intellectual property laws.
7.2 Your Content
You retain ownership of your business data, product listings, and content uploaded to the Service. By using the Service, you grant us a limited license to process this data solely for the purpose of providing the Service to you.
8. Service Availability
We strive to maintain 100% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with 30 minuts advance notice when possible. We are not liable for downtime caused by third-party services, force majeure events, or circumstances beyond our control.
9. Limitation of Liability
To the maximum extent permitted by law:
The Service is provided "as is" and "as available" without warranties of any kind.
BikriAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
We are not responsible for the accuracy, completeness, or appropriateness of AI-generated responses.
10. Indemnification
You agree to indemnify and hold harmless BikriAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
Your use of the Service.
Your violation of these Terms.
Your violation of any third-party rights, including intellectual property rights.
Content or messages sent by the AI agent on your behalf.
11. Disclaimer
The AI agent generates responses based on patterns in data. AI-generated content may occasionally be inaccurate, inappropriate, or unexpected. You are responsible for monitoring and reviewing the AI agent's responses. BikaiAi is not a substitute for human customer service where critical or sensitive matters are involved.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Dhaka, Bangladesh.
By using BikriAI, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
